To an action for a libel in a newspaper the defendant pleaded a plea, under the 6 7 Viet. c. 90, s. 2, alleging that he inserted a full apology, c.; and he paid 51. into court. The jury, having found the apology not sufficient and the plea therefore not proved, were directed by the judge to assess the damages irrespective of the 51. paid into court, and without considering that payment in any way as an admission of liability: - Held, a proper direction.
